Developers at Ironmace have officially announced that Dark and Darker can continue development with "full legal certainty." This follows a landmark decision by South Korea’s Supreme Court, which upheld previous rulings in the long-running legal battle between Ironmace and Nexon. The court has dismissed appeals from both parties, effectively settling the dispute over the game's copyright status.

The Verdict on Copyright Infringiment

The legal conflict began when Nexon accused former employees of stealing trade secrets related to a canceled project codenamed "P3" to create Dark and Darker. Ironmace has consistently maintained that they never used any stolen assets or code during the production of their title.

While the dispute was intense, the court's findings provided significant relief for the developer. The ruling established several key points regarding the ongoing litigation:

A lower court previously ruled that trade secret infringement did occur because CEO Choi Ju-hyun stored Nexon data on a personal server before establishing his independent studio.

While the infringement was recognized, the appellate court lowered the required damages to 5.7 billion won, which is approximately $4 million USD. With the Supreme Court now upholding this decision, the legal hurdles surrounding the copyright of Dark and Darker appear to be over, allowing the team to focus entirely on the game's future.
